The Haryana Government Labour Department has issued an Extraordinary Gazette Notification (No. 02/26/2026‑2Lab) granting a significant compliance relief to establishments operating in the state. Acting under Section 28 of the Haryana Shop and Commercial Establishments Act, 1958 (Punjab Act 15 of 1958) and read with the Occupational Safety, Health and Working Conditions Code, 2020 (Act 37 of 2020), the Governor of Haryana has exempted establishments registered under Section 3 of the OSHWC Code from the requirement of separate registration or business‑commencement intimation under Sections 13 and 13A of the 1958 Act.

Purpose and Legal Context

The notification seeks to eliminate duplication of registration and compliance processes once the Haryana Rules under the OSHWC Code are finalised. This move aligns with the central government’s labour‑law rationalisation initiative, ensuring that businesses registered under the new Code are not burdened with overlapping procedural requirements under older statutes.

Scope of Exemption

The exemption applies to all establishments situated in Haryana that are covered under the Shop and Commercial Establishments Act and subsequently registered under the OSHWC Code. These establishments will no longer need to file separate registration or commencement intimation under the 1958 Act.

Continuing Obligations

Importantly, the notification clarifies that other provisions of the 1958 Act remain applicable to the extent they are not inconsistent with the OSHWC Code, 2020. Employers must therefore continue to comply with relevant provisions on working hours, holidays, and employee welfare unless superseded by the new Code.
